WARRANTY TERMS AND CONDITIONS 

Please read the following document carefully. This document describes what is included in the New Product Warranty, and what is not covered by the New Product Warranty. By purchasing from us, you agree to the terms and conditions of this Warranty.

The Consumer Guarantees Act and Fair-Trading Act provide the basis of Eco Group’s Warranty policy. The Consumer Guarantee Act sets out minimum standards for goods sold by Eco Group. In the event that goods sold are not fit for purpose, or are faulty, the Customer has the right to a repair, replacement or a refund.

The Fair-Trading Act is designed to protect the Customer from being misled, either intentionally or unintentionally. This applies to all aspects of the promotion and sale of goods and services including; pricing, where the product was made, where the product is from, the meeting of New Zealand safety standards, availability of products in store and the sales techniques used. The Commerce Commission enforces the Fair-Trading Act 1986.

Eco Group’s products have a minimum 5-year Warranty from date of purchase. Warranty claims cover any fault, defect or failure occurring as a result of the manufacturing process. Damage or faults occurring as a result of misuse, accident or wear and tear are not covered by our Warranty policy.

If the product is still under Warranty, then the repair will be at our expense including the freight to return the repaired or replacement product. If the product is out of Warranty, then we can still have the product repaired, however, the cost of the repair will be charged to the customer.

  1. General 

1.1. Eco-Group Limited (‘Eco Group’) with company number 1274266 gives this New Product Warranty (‘Warranty’) in relation to its bike rack (the ‘Product’).

1.2. Eco Group warrants that the Product purchased from us is covered by a full manufacturer’s Warranty. Generally, warranties cover manufacturing faults and defects. They do not cover damage caused by crashing, abuse, general wear and tear etc. If you feel that the Product you purchased from us has developed a fault, then please contact the store where you purchased our Product. If the Product needs to be returned, you must provide proof of purchase. When the Product is returned, it will be assessed by our Warranty Department. Replacement goods will be dispatched once approved. We will contact you in cases that are not deemed to be valid for Warranty.

1.3. Any reference herein to “we”, “our”, or “us” means Eco Group. Any reference to “you” or “your” means you, as the original consumer purchaser (‘Customer’).

  1. Limited Warranty 

2.1. Eco Group warrants to the Customer that the Product supplied by us will be free from manufacturing defects, and under normal use when reasonable care and maintenance is applied, within the Warranty periods set out in these Terms.

2.2. This Warranty is limited to the first purchaser in New Zealand, and it is not transferable on the sale or other disposition of the Product.

2.3. The liability of Eco Group under this Warranty is limited to the repair or replacement the Product(s) or defective part of the Product(s) or the cost of such repair or replacement in the discretion of Eco Group.

2.4. To the fullest extent permissible at law, Eco Group’s liability for incidental and consequential damages resulting from the operation, maintenance, or use of your Product is expressly excluded.

  1. Warranty Coverage and Warranty Period 

3.1 Subject to these terms and conditions, this Warranty continues for a period of 60 months following the date of original purchase of the Product.

How you can make a claim 

To enquire about claiming under this Warranty, please follow these steps:

(a) carefully check the operating instructions, user manual and the terms of this Warranty.

(b) have the model and serial number of the Product available.

(c) have the proof of purchase (e.g. an invoice) available;

(d) telephone the numbers of the store where our Product was purchased 

ALL WARRANTY DEFECTS MUST BE REPORTED TO AN AUTHORISED ECO GROUP REPRESENTATIVE AS SOON AS POSSIBLE AND WITHIN A REASONABLE TIMEFRAME.

(e) In order to make a claim under this Warranty, a Customer must, at their own cost present the Product to an Authorised Service Dealer and collect the Product at their expense once notified that it is ready for collection.

(f) Eco Group reserves the right to inspect and test defective part(s) that are the subject of any claim under this Warranty.

(g) The servicing or repair of your Products by third parties that are not authorised by Eco Group will void your Warranty and will not be liable for damages, defect or failure caused by having the Product serviced or repaired by third parties that are not authorised by Eco Group.

(h) Eco Group reserves the right to, at its discretion, deny or cancel all or a portion of the reimbursement and/or warranties given under this Warranty, in the event that you present incomplete, insufficient, false and/or fraudulent claims and/or documents in relation to this Warranty.

4.2 To honour a valid claim made under this Warranty, we will either repair or replace the Product within the applicable Warranty period free-of-charge or authorise the Product to be replaced or repaired free-of charge. Unless required by law, our maximum liability extends to the repair or replacement of the defective Product, or at our sole discretion, a full refund up to the maximum purchase price.

  1. Warranty Exclusions 

5.1. The scope of this Warranty is expressly limited to items constructed by Eco Group.

5.2. Claims that do not fall under the term “defects from manufacture” will not be covered by this Warranty. Claims that will not be covered include, but are not limited to, claims in relation to:

(a) Damages caused by Acts of God, including, but not limited to hurricane, flooding, earthquake, fire, or other types of natural disasters, or, as a result of unforeseen circumstances; acts of negligence, terrorism, or product misuse or abuse.

(b) Misuse – Any defects resulting from operator negligence, misuse, or abuse, loading beyond specified load and capacity, use in off road condition beyond the designed or intended use of the Product.

(c) Modifications – Any modifications, dismantling or other alterations that have not been approved by Eco Group. Any defect caused by changes to original equipment and the fitment of non-approved parts or accessories.

(d) Overloading – Any defects resulting from Product being subjected to overloading, for any period of time.

(e) Reporting and repairs – Failure to report Warranty defects in a reasonable time and/or have defects repaired in a reasonable time. Failure to have the Product repaired in a reasonable time in accordance with the manufacturer’s recommendations following an accident or other damages within a reasonable time after the defects became known or suspected.

(f) Rust and powder coat – This Warranty does not cover the cosmetic appearance of your Product and excludes deterioration due to rust or the fading of any painted or other types of surfaces.

(g) Wear and Tear – This Warranty does not cover normal wear and tear; nor does it cover components of the Product that malfunctions, damages or is replaceable such as anchor cleats and tie downs.

  1. Guarantees under the New Zealand Consumer Law 

6.1. Our Product come with guarantees that cannot be excluded under the New Zealand Consumer Guarantees Act 1993

6.2 This document should not be read as excluding, restricting or modifying your rights and remedies under the Consumer Guarantees Act 1993.

The guarantees do not apply to the Product where:

  • You got what they asked for but changed your mind;
  • You misused or altered the Product in any way that caused the problem, e.g not following instructions for use;
  • You damaged, lost or disposed of the product after delivery.
  • You were aware of the Product’s fault before you bought the product.
  • You took an unreasonable time to return the Product or cancel the service; and
  • You experienced a service problem that was outside of our control, e.g. a natural disaster, or was caused by someone you are not responsible for.
  1. Keeping your details up to date 

7.1. The New Zealand Government requires manufacturers to be able to contact the current product owner if any recall or service campaigns become necessary. Should you change your address or sell your product, please email sales@ecogroupnz.co.nz

  1. Privacy 

8.1. By accepting Terms set out in this Warranty, you agree to your personal information being used and disclosed for the purpose of providing Warranty services, and for the purpose of providing information about other products offered by Eco Group and its related companies.

Eco Group is required to seek personal information from its Customers who seek to make a claim under this Warranty. Such personal information may be used by Eco Group and/or any Authorised Service Dealer (who is authorised to process Warranty claims and/or carry out warranty repairs on behalf of Eco Group) for the purpose of processing such Warranty claim and also for the provision of customer support and further information about Eco Group’s products and services (Purpose).

If a Customer does not wish to provide Eco Group and/or its Authorised Service Dealer with personal information, Eco Group may be unable to process the Customer’s Warranty claim or to provide the Customer with additional customer support, services, and information. Eco Group is committed to protecting the privacy of personal information and will act in compliance with applicable privacy law in New Zealand and New Zealand’s Information Privacy Principles described in the Privacy Act 1993 (NZ).

Eco Group takes security measures in order to protect any personal information collected in the Warranty claim process against manipulation, loss, destruction, access by unauthorised persons or unauthorised disclosure. Eco Group will not disclose any personal information to third parties other than for the Purpose or except as required by law. A Customer has the right to access the personal information Eco Group, or its Authorised Service Dealers hold about them.

The Customer can request to see, change, or modify the personal information held about them, or withdraw consent for its usage, by contacting Eco Group at the through our contact information below.

  1. Laws and Jurisdiction 

9.1. These General Terms will be governed and construed in accordance with the laws of New Zealand. We both submit to the non-exclusive jurisdiction of the New Zealand courts.
